Charles A. Nemer is a principal at McCarthy Lebit. Charles’s practice focuses mainly on municipal law, land use and development issues, title insurance defense, commercial foreclosures, receivership practice, real estate litigation, business transactions, real estate acquisitions and financing, as well as all areas pertaining to liquor law. Charles has served the title insurance industry in many capacities, including general counsel for a title agency as well as title insurer claims counsel. He has successfully prosecuted a wide variety of cases involving zoning and land issues.

Charles has represented numerous local and national property owners and developers regarding zoning and land use issues throughout Ohio. He is familiar with the permit application process and has counseled private and public entities in appeals of decisions rendered by municipal bodies, commissions and councils on request for variances, permits and plan approvals.

Charles has extensive experience with all aspects of commercial and industrial real estate transactions including commercial real estate workouts. In his practice, he negotiates and drafts business organizational documents, as well as purchase, sale, options, and other transaction agreements and related documents. These include loan documents, commercial leases, easements, options and right of first refusal agreements. Charles also assists borrowers in determining the correct vehicle for loan resolutions, such as forbearances, loan modification, discounted payoffs, deed in lieu of foreclosure, loan assumption, non-judicial foreclosures and lender liability litigation.

In his receivership practice area, Charles has represented court appointed receivers, as well as parties who have sought the appointment of a receiver. These parties include lenders, both regionally and nationally, as well as private parties.

As a result of his devotion to public work, Charles was appointed to the Ohio Lottery Commission by Governor Bob Taft and approved by the Ohio Senate in 2001. He was reappointed in 2004 and elected by his fellow Commissioners as Vice-Chair. Charles is currently the Law Director and Prosecutor for Bentleyville and the Magistrate for Newburgh Heights.
