McCarthy Lebit’s Taxation practice counsels and represents individuals and businesses in all matters related to taxation. Our attorneys have the experience and credentials to protect client interests and provide solutions that minimize their legal and financial exposure. We act directly as legal counsel or assist other attorneys and tax professionals.

We represent individuals and businesses in matters involving audits, collections, appeals and litigation before the Internal Revenue Service, the Ohio Department of Taxation and local tax authorities. We resolve controversies over business and individual income tax returns and net profits tax returns, estate taxes, payroll taxes, trust fund taxes, sales taxes, real estate taxes and commercial activity tax.

Our lawyers help clients prepare for audits and propose offers in compromise, extensions and mitigation of penalties. We also undertake federal, state and local appeals and appear in US Tax Court, US District Court, US Court of Appeals, local Boards of Revision and the Ohio Board of Tax Appeals on behalf of our clients. Furthermore, our Criminal, Cyber & White Collar practice defend clients against tax fraud, tax evasion, and other white collar criminal charges We also represent clients in collection cases with the IRS and the State of Ohio.

O’Neill v. Commissioner

O’Neill v. Commissioner – Wrote the winning brief in the nationally-recognized tax case of O’Neill v. Commissioner, 994 F.2d (6th Cir.). This case against the IRS allowed trustees to deduct investment management expenses without a 2% of income deduction. It is significant to any individual who uses an investment manager to handle his or her investment account. When the United States Supreme Court addressed this same issue in Knight v. Commissioner, they overturned O’Neill on a statutory construction basis.
