McCarthy, Lebit, Crystal & Liffman Co., LPA is pleased to announce that Ann-Marie Ahern has been elected to serve on the Board of Trustees for the Cleveland Bar Foundation. The Cleveland Bar Foundation, the Cleveland Bar Association's related charitable arm and partner in serving the legal profession and the community, directly supports the programs that are making a difference in the lives of people in the community-providing pro bono representation to the indigent and homeless; public education about the law, legal rights and responsibilities and mentors to children in the Cleveland Municipal Schools through law-related citizenship education. Ahern's term as a Trustee is for two years.

CASE UPDATE
Christian Patno recently filed a case of first impression in Ohio where a minor child sustained significant permanent debilitating injuries from meningitis. This tragedy occurred after the child's doctor's office not only failed to give the meningitis vaccine, Menactra (that is 97% effective in preventing the disease, as required by the American Association of Pediatrics), but also failed to even advise the parents of the child of the vaccine.
Another case he is also currently working on is defending a triple-fatality plane crash case where claims of product liability have been brought against our client. Due to the age of the plane, Federal GARA and Ohio's new Statute of Repose defenses have been asserted. These statutes provide protection since the product alleged to have been manufactured by our client predated the crash by so many years. Therefore the plaintiff's claims are arguably precluded due to time limits.
On March 30, 2007, Christian Patno and his co-counsel, won a new wrongful death trial in the Ninth District Court of Appeals following a highly unusual defense verdict that resulted following a several day 4-4 deadlock. Mr. Patno had requested more than $25 million dollars from the jury following a two week trial that involved the tragic death of a Columbia Gas Company employee resulting from inadequate safety procedures. The Appellate Court ordered a new trial when it found the trial judge had improper ex parte communication with the jury during deliberations outside the presence of counsel. This communication was presumed by the Appellate Court to be prejudicial to the deliberation. The Appellate Court opinion was a very lengthy 18 pages in length. Although a retrial has been scheduled for July 2, 2007 the gas company has stated they will appeal the Appellate Court decision to the Supreme Court of Ohio.
Also, in March Mr. Patno settled another case involving the near-drowning of a minor child at a private health club facility. This is the sixth water-related injury case that Mr. Patno has handled over the past 10 years. To date, Mr. Patno still holds the highest drowning jury verdict in the State of Ohio ($3,150,000) obtained in Cuyahoga County.

Stuart Mintz will be presenting Residential Real Estate Transactions at the Forum on October 12, 2007 through the Ohio State Bar Association..
Christian Patno will be speaking at the Ohio Assocation of Justice annual medical malpractice seminar on October 26, 2007 on the recent Ohio Supreme Court decision in Theobald. The focus will be on the broad-reaching practical effects of this new decision and how practitioners can protect their clients from claims of immunity. Chris will also be presenting an opening statement and closing argument for one side to mock jury on September 28, 2007 in Cleveland for the Ohio Association of Justice continuing legal education series What do Juries Think, where deliberations will take place after the opponents present their side and the attendees will secretly watch jury deliberations on closed circuit monitors.
