McCarthy Lebit’s Education Practice Team has extensive experience representing college students facing Title IX proceedings.
We are a full service education practice able to navigate the frequent intersection of Title IX law, student misconduct matters involving drugs and alcohol, education disabilities and mental health struggles. Every client matter is staffed with Team members who bring a wealth of experience and drive to help students in their time of crisis.
Our attorneys work with students facing Title IX issues involving sexual assault, sexual harassment, and intimate partner violence on campus. We also have significant experience with matters where a criminal investigation is underway and a coordinated defense is necessary. Students should not act alone in these cases, but should seek a team of trained professionals to navigate the complexity of the circumstances. We similarly represent faculty members involved in Title IX matters or other issues on campus that may pose a threat to their careers.
We understand not only the sensitivity of these matters, but the effect that the outcome will have on our clients’ futures. We work tirelessly to obtain the best results possible for our clients and take the time to advise our clients on the most appropriate measures to ensure their future success and to protect their academic transcript.
Our flexible and dynamic approach to cases has led to many positive resolutions. Our Team has had many Title IX cases dismissed prior to an administrative hearing, which allows the students to move forward with an unblemished record. In other cases, our Team has had falsely accused students found “not responsible” after compelling evidence was presented to the university panel. Indeed, in cases where there was evidence on both sides of the equation, our Team has successfully negotiated Restorative Justice Plans.
In addition, our Team has been retained in matters where students were found responsible after the conclusion of hearings. In these cases, successful appeals were granted after new and compelling arguments were presented to the academic institution. Also, where a finding of responsibility remains, our Team has fought to secure the sealing of the records so that respondents can look forward to a bright future without being limited by the past.
Our Team understands the Title IX process from both sides of the equation. We have served as students advisors to both genders and to students with a variety of mental health issues and personal concerns. In particular, the Team has experience with students who have various disabilities, such as ADHD, Autism Spectrum Disorder, Anxiety and Depression.
In order to provide clients with the elite Team of lawyers they deserve, we work closely with other practices areas in our firm. We often call on our Criminal, Cyber & White Collar attorneys to handle any criminal matters related to campus proceedings, as well as our Employment lawyers when representing faculty issues related to discipline or tenure.
Our team works closely with Title IX Consultant Dayna Hloska to provide our clients with well-rounded services that address their needs from all perspectives.
